Leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, has asked the Federal High Court in Abuja to order his transfer from the custody of the Department of State Services (DSS) to the National Hospital, Abuja, for urgent medical treatment.
The application, filed by his counsel, Kanu Agabi, SAN, relates to his ongoing trial in Suit No. FHC/ABJ/CR/383/2015.
Kanu’s legal team informed the court that his health has deteriorated while in detention, citing medical reports indicating liver and kidney complications, critically low potassium levels, and a swelling under his armpit.
His lawyers argued that access to appropriate medical care is a fundamental human right and essential to his right to life. They warned that denying him access to adequate treatment outside of DSS custody poses a serious risk to his survival.
The case was heard on Monday before Justice Musa Liman at the Federal High Court in Abuja.
Justice Liman admitted the application during the court’s vacation session, following the legal team’s request for an urgent transfer to the National Hospital for specialist care.
The judge directed that the DSS be properly served with the motion and hearing notice, allowing the agency to file its response.
The court’s ruling will determine whether Kanu will be transferred for medical treatment under DSS supervision.
